PRIVACY POLICY
ZESPRI International Limited ("ZESPRI") is committed to ensuring the privacy of all our customers and Contest entrants. Our policy describes the choices you can make about how we collect and use your information. ZESPRI handles your personal information in accordance with the federal Personal Information and Protection and Electronic Documents Act ("PIPEDA") and all relevant provincial privacy legislation, as applicable to each customer or Contest entrant.
By viewing this website and entering The Great Kiwi Adventure ("Contest"), you are consenting to the information collection, use and disclosure practices described in this privacy policy.
- PURPOSE
ZESPRI collects personal information from its customers and Contest entrants for two reasons. First of all, we use your personal information to confirm eligibility for the Contest and to contact the selected winner. ZESPRI and Air New Zealand also use your personal information to send you promotional materials regarding ZESPRI and/or Air New Zealand products and promotions. However, ZESPRI and Air New Zealand will only send you promotional materials if you have selected that you wish to receive them on the Contest entry form.
- INFORMATION COLLECTED
Personal information is defined in PIPEDA as "information about an identifiable individual." The personal information that ZESPRI and Air New Zealand collects about its customers and Contest entrants is their name, address, and e-mail address ("Personal Information"). Your Personal Information is collected when you submit a Contest entry form on our website.
- COLLECTION OF NON-PERSONALLY IDENTIFIABLE INFORMATION
The ZESPRI website automatically collects non-personally identifiable information from you when you visit our site. This includes information about your Internet service provider, browser type, domain name, Internet Protocol (IP) address, the website that referred you to us, the web pages you request, the date and time of those requests, and entry and exit points. ZESPRI aggregates this information about your visit with those of other visitors. You are not personally identified in any way.
Our collection of website use information may involve the use of Google Analytics and cookies. Google Analytics is a passive counting tool that records non-personal information about web page visitors, such as IP addresses of the users' ISP. Cookies are data files that a website sends to your computer while you are viewing the site. These data files include information that allows our site to remember important information that will make your use of the site more efficient and useful to you.
This information helps us provide you with a continually improving and enhanced online experience, including ease and speed of navigation to help you find the products, services and information you need. - INFORMATION FROM CHILDREN
ZESPRI's website is a general audience site that is not designed nor intended to collect Personal Information from children under the age of 13. ZESPRI does not knowingly collect Personal Information from anyone under the age of 13, and does not use such information if it discovers that it is has been provided. To respect the privacy of children, children under the age of 13 should not provide any Personal Information on this Site.
- CONSENT
Your consent to the collection, use and disclosure of your personal information is given at the time of entry to the Contest. It is your right to withdraw full or partial consent. Please be aware that withdrawing your consent may result in invalidation or cancellation of your entry into the Contest. To withdraw your consent, please contact our Privacy Officer at the address below.
Consent to receive promotional material can also be withdrawn by following the "opt-out" instructions found on ZESPRI and Air New Zealand promotional material.
As is customary in many businesses, ZESPRI may purchase and use "opt-in" e-mail lists to contact potential customers. We will honour "opt-out" requests and ask those providing lists to give us assurances that e-mail contact information is provided only for those individuals who have expressed a desire to receive offers and information by e-mail
Please also note that even if you opt out of receiving promotional emails from us, we may still use your information to communicate with you for other purposes, such as orders, purchases and customer service responses
- DISCLOSURE TO THIRD PARTIES
ZESPRI will not disclose your Personal Information to any third parties except those specified in this privacy policy.
ZESPRI reserves the right to disclose your Personal Information to Air New Zealand for the purposes of confirming Contest eligibility and to send you Air New Zealand promotional material, depending on your "opt-in" preference specified on your Contest entry form.
ZESPRI may disclose Personal Information without your consent only to ZEPSRI's legal counsel, to collect a debt you may owe to ZESPRI, to comply with an order made by a court, to a government institution that has requested the information for purposes of law enforcement, to an investigative body under PIPEDA, when required by law, or to protect our or others' rights, property, or safety. We do not provide information to these parties for marketing or commercial purposes.
In the event of a sale of some or all of ZESPRI's assets or business, ZESPRI may disclose Personal Information to those involved in a transfer of all or part of the assets or business. If such an event were to occur, ZESPRI would strive to ensure that the recipient will treat your Personal Information as described in this policy.
- SECURITY
ZESPRI strives to maintain appropriate physical, technical and administrative security with respect to its offices and information systems so as to prevent any loss, misuse, unauthorized access, disclosure, or modification of personal information. While we strive to safeguard your personal information once we receive it, no transmission of data over the Internet or any other public network can be guaranteed to be 100% secure.
- RECORD RETENTION
Personal information provided to us, required for entry to the Contest and receipt of promotional materials will not be destroyed in a scheduled manner.
- ACCURACY
You have the right to correct any of the personal information we have on file for you. To do so, please send a written request to our Privacy Officer at the address below. To aid in processing your request, please include the following details:
- Contact information (Name, Address and e-mail address)
- Details of the request (eg., change of e-mail address, unsubscribe from promotional information, etc.)
- ACCESS TO INFORMATION
Access to your personal information is available upon your written request. A fee will be charged for this service. Requests for access to information should be sent to our Privacy Officer at the address below.
ZESPRI will decline access to Personal Information where the information requested:
- would likely reveal personal information about a third party, unless the requesting individual's life, health or security is threatened; or
- has been disclosed to a government institution for law enforcement or national security reasons.
ZESPRI reserves the right to decline access to Personal Information where the information requested:
- is protected by solicitor-client privilege;
- would reveal confidential commercial information;
- reasonably be expected to threaten the life or security of another individual;
- was collected without the knowledge or consent of the individual in order to investigate a breach of an agreement or a contravention of the laws of Canada or a province, and obtaining knowledge and consent would compromise the availability or accuracy of the information;
- was generated in the course of a formal dispute resolution process; or
- does not exist, is not held, or cannot be found by ZESPRI.
Where information will not or cannot be disclosed, the individual making the request will be provided with the reasons for non-disclosure. ZESPRI will not respond to repeated or vexatious requests for personal information that have previously been lawfully denied.
Where information will be disclosed, we will endeavour to provide the information in question within a reasonable time and no later than 30 days following the request.
- LINKS TO OTHER SITES
ZESPRI's website contains links to other websites. While ZESPRI takes measures to ensure that the links on our website are to reputable and well-established companies, we are not responsible for the privacy practices of those websites and we have no control over the information that is collected by other companies and websites. You are solely responsible for learning about the privacy policies and practices of those companies and websites.
- CHANGES TO THE PRIVACY POLICY
ZESPRI may amend this policy from time to time. Any changes to our privacy policy will not change ZESPRI's commitment to the safeguarding of your personal information, or the manner in which we use it. If we make any substantial changes we will notify you by sending a notice to the e-mail address specified on your Contest entry form or by posting a prominent announcement on our website.
